Statute: 765 ILCS 710/1 (as amended by P.A. 103-0224)
NO statewide cap — Cook County (outside Chicago) caps deposits at 1.5 months' rent; Chicago has no cap but strict interest and receipt rules. Itemized statement within 30 days, refund within 45; since Jan 1, 2024 these rules apply to ALL landlords (the old 5+ unit threshold was removed).
Laws change quietly. California cut its deposit cap to one month in 2024, New York in 2019. Get an email when Illinois changes its rules — and what to update in your lease.
