Security Deposit FAQ

How much can a landlord charge for a security deposit?

It depends on your state. Some states cap deposits at 1x monthly rent (California, New York, Massachusetts), while others allow 2x rent (Virginia, Maryland, Connecticut) or have no limit at all (Texas, Florida, Georgia). Use the calculator above to check your state's specific limit.

How long does a landlord have to return a security deposit?

Return deadlines range from 14 days (New York, Vermont, South Dakota) to 60 days (Alabama, West Virginia). Most states require 30 days. The deadline starts when the tenant moves out and returns keys.

What can a landlord deduct from a security deposit?

Landlords can typically deduct for unpaid rent, damages beyond normal wear and tear, and cleaning costs if the unit wasn't left in the condition specified in the lease. Normal wear (scuff marks, faded paint, worn carpet) cannot be deducted.

Does a landlord have to put the security deposit in escrow?

Some states require it — including Connecticut, Florida, Georgia, Kentucky, Maryland, Massachusetts, New Jersey, New York, and Washington D.C. Check your state's requirements above.

Can a landlord charge a separate pet deposit?

Most states allow a separate pet deposit, but some (California, New York, Massachusetts) include pet deposits in the total deposit cap. Service animals cannot have a deposit charged per federal law (Fair Housing Act).

What happens if a landlord doesn't return the deposit on time?

Penalties vary by state but can include forfeiting the right to make deductions, paying double or triple the deposit amount, or paying the tenant's attorney fees. In New York, failure to return within 14 days means the landlord forfeits the right to any deductions.
